Baltimore Cyber Range LLC (“BCR Cyber”, “we”, “us”) understands that privacy and security are important to the people from whom we solicit information. This Privacy Policy outlines the ways we collect, use and disclose information and specifically describes our practices in connection with information that we collect through websites operated by us or on our behalf, through email messages that we exchange with you, as well as other interactions you may have with us. BCR Cyber reserves the right to update this Privacy Policy at any time without notice to you, in which case the new Privacy Policy will be applicable to the collection and use of your information by BCR Cyber.
INFORMATION WE COLLECT
BCR Cyber collects both personal and non-personal information in the course of its business activities. “Personal Information” is any factual or subjective information about an identifiable individual. Personal Information can directly or indirectly identify you as an individual and may include, but is not limited to, your name, email address, telephone number, postal address, online digital identifiers, your browser and device information, and information collected through digital tracking technologies. BCR Cyber collects Personal Information from you through our website (the “Website”), portals we control and through our interactions with you.
Contact information, such as your name, email address and any other Personal Information you may include, is sent to us directly when you send us a message at the email address found on our Website. BCR Cyber also collects Personal Information from the device you use to access our Website. The information we collect in this manner may include, but is not limited to, your device model, operating system, browser type, IP address, domain name, internet service provider, browsing history related to this Website, clickstream data, referring website address, connection speed, language settings, location, and time-of-day. BRC Cyber does not employ the use of cookies or tracking technologies.
Your Personal Information will be stored and processed in the United States, which may have data protection rules that are different from those of your country.
We use Google Analytics on our Website to collect and analyze the information discussed above, and to engage in auditing, research or reporting. The information (including your IP address) collected will be disclosed to evaluate your use of the Website, including by noting the third-party website from which you arrive, analyzing usage trends, assisting with fraud prevention, and providing certain features to you. USE OF INFORMATION WE COLLECT
BCR Cyber uses your Personal Information in order to conduct its legitimate business activities which include, but are not limited to, fulfilling information and other requests, marketing, promotion, recruiting, internal research and reporting, providing and improving products and services, and enforcing our Terms and Conditions.
BCR Cyber uses the Personal Information you provide us to send you messages regarding our products and services including, but not limited to, physical and virtual newsletters and brochures. BCR Cyber will also use your Personal Information to provide you with information and/or offers tailored to your interests, or to communicate with you directly. BCR Cyber also uses your Personal Information to manage its contractual relationship with you, if such exists, by responding to your inquiries, providing technical support, processing payments and providing other support activities. Finally, BCR Cyber may use your Personal Information to improve its products and services. BCR Cyber will also use your Personal Information to better understand you, so that we can personalize our business transactions.
We may use third-party web analytics services (such as those of Google Analytics) on our Website to collect and analyze the information discussed above, and to engage in auditing, research, or reporting, to maintain the quality of our services and to provide general statistics regarding the use of our services. The information (including your IP address) collected by various analytics technologies will be disclosed to or collected directly by these service providers, who use the information to evaluate your use of the Website, including by noting the third-party website from which you arrive, analyzing usage trends, assisting with fraud prevention, and providing certain features to you. Finally, BCR Cyber may use your Personal Information for any other purpose described to you at the time BCR Cyber collects the information from you.
DISCLOSURE OF PERSONAL INFORMATION
BCR Cyber does not sell, rent or lease any Personal Information to third parties. We may, however, disclose Personal Information to our vendors, service providers, marketing partners and educational institutions with which we work in order to conduct our legitimate business activities. BCR Cyber may also need to disclose your Personal Information as required by law or to protect its legal rights.
BCR Cyber shares your Personal Information with its vendors and service providers (“Sub-Processors”) in order to conduct its legitimate business activities. These activities may include, but are not limited to, the provision of cyber training, testing, certification and job placement services. BCR Cyber may also share your Personal Information with its marketing partners, to permit them to send you marketing communications. Currently, BCR Cyber’s Sub-Processors include Amazon Technologies, Inc., Microsoft Corporation, Salesforce, Inc., Instructure, Inc., Zapier, Inc., EdInvent, Inc. and Adobe Inc. BCR Cyber will bind its Sub-Processors to contractual terms which are as protective of the Personal Information you provide us as those in this Privacy Policy, but BCR Cyber is not responsible for any data which you provide to a Sub-Processor directly and we encourage you to review any terms or privacy policy information on any third-party website you visit or which is linked to from our Website.
BCR Cyber shares your Personal Information with its affiliates for its legitimate business purposes and may disclose or transfer your Personal Information pursuant to a re-organization, merger, sale, joint venture, assignment, or other transfer or disposition of all or any portion of our business.
It may become necessary for BCR Cyber to share your Personal Information for legal reasons. These can include a need to comply with applicable law inside or outside the United States and/or to respond to requests from public and government authorities, including law enforcement authorities. BCR Cyber may also need to disclose your personal information in order to enforce our Terms and Conditions, participate in a judicial or regulatory proceeding, or to protect and defend our rights or the rights of others. Finally, BCR Cyber may need to disclose your Personal Information in order to prevent fraud, support auditing, compliance and corporate governance functions, or to protect the vital interests of a person.
RETENTION OF PERSONAL INFORMATION
Your Personal Information, and any other information we gather, may be held by BCR Cyber indefinitely, or for as long as is necessary so that we may maintain a relationship with you, to protect ourselves against legal claims, or for record-keeping purposes.
You may request to review, correct, update, suppress, restrict or delete Personal Information that you have previously provided to us. We will respond to your request consistent with applicable law.
If you request that we delete your Personal Information, BCR Cyber will make reasonable attempts to delete all instances of your Personal Information in their entirety. To request such deletion, please send an email to: inquiry@bcrcyber.com.
LEGAL BASIS FOR PROCESSING PERSONAL INFORMATION
BCR Cyber processes Personal Information under the law at all times. The legal grounds under which BCR Cyber processes Personal Information include:
- Your consent, which is given when you use our Website or our business services
- Our legitimate business activities as described above
- Honoring our contractual commitments
- Compliance with the law
SECURITY
BCR Cyber has implemented generally accepted security measures to protect against the loss, misuse, disclosure, alteration or destruction of the Personal Information we gather. However, no electronic data transmission can be guaranteed to be completely secure. Though we utilize such measures, we cannot guarantee against the loss, misuse, or alteration of your Personal Information. BCR Cyber cannot guarantee that unauthorized individuals will not obtain access to your Personal Information, and you provide us your Personal Information at your own risk.
OPT-OUT RIGHTS
Though BCR Cyber gathers and retains Personal Information as described above, you may opt out from receiving marketing emails from us by either following the opt-out instructions in those emails or by sending an opt-out request via email to: inquiry@bcrcyber.com.
You may also opt out of receiving other types of communications from us, including but not limited to phone calls, texts and mailings by sending an email to: inquiry@bcrcyber.com.
BCR Cyber will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt out of receiving marketing-related communications from us, we may still send messages to you pursuant to an existing business relationship which we may have with you.
CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and our mobile applications include a do-not-track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.
GENERAL RIGHTS OF ACCESS, DELETION, CORRECTION AND PORTABILITY
You have the right to make a reasonable request to access, delete or correct your Personal Information that we retain. You also have the right to obtain a copy of your Personal Information which we process in a portable and, to the extent technically feasible, readily usable format that allows you to transmit it to another processor without hindrance. Please submit such request, or any requests under specific state law, by sending an email to: inquiry@bcrcyber.com and we will respond without undue delay and, in any event, within forty-five (45) days. Certain states have adopted data privacy laws which provide you with additional rights, as described below.
CALIFORNIA CONSUMER PRIVACY ACT
Under the California Consumer Privacy Act (“CCPA”), California residents have additional privacy rights available to them. These include the right to be notified at or before the point at which Personal Information is collected, the right to opt out of the sale of Personal Information, the right to request deletion of Personal Information, the right to receive copies of, or information about, the Personal Information we collect, the right to be free from discriminatory treatment for the exercise of the privacy rights conferred by the CCPA, and the right to receive information about financial incentives we may offer you, if any. California residents also have the right to designate an authorized agent to make a request under the CCPA on the resident’s behalf.
